📱 SMS & Email Messaging Compliance

GiftLoop is fully compliant with TCPA, CAN-SPAM, CTIA, and carrier requirements

• EXPRESS CONSENT REQUIRED: Customers must explicitly opt-in to receive messages. Simply providing a phone number is NOT consent. Customers must take an affirmative action (checking a box, clicking "Set Reminder") with clear disclosure of message frequency and content.
• MESSAGE FREQUENCY: Customers will receive 1-2 messages per occasion they sign up for (14 days and 7 days before). Messages are sent 7 days apart. Transactional reminders only - no promotional content unless specifically requested.
• OPT-OUT MECHANISM: Every SMS includes "Reply STOP to unsubscribe" - opt-outs are processed immediately and automatically. Email includes clear unsubscribe links. We maintain suppression lists to prevent re-messaging opted-out users.
• MESSAGE CONTENT: Messages contain: Store name, reminder purpose, days until occasion, optional discount code, and opt-out instructions. No deceptive content or third-party advertising.
• DATA RATES DISCLOSURE: "Message and data rates may apply" is clearly displayed at opt-in and in terms of service.
• SAMPLE OPT-IN LANGUAGE: "By clicking below, you agree to receive 2 automated marketing text messages about this gift reminder. Msg & data rates may apply. Reply STOP to cancel, HELP for help."
• RECOMMENDED MESSAGING STRATEGY:
  • 14 Days Before: "🎁 [Store Name]: Hi [Name], your anniversary is coming up on Sept 15 (2 weeks away). Get ready early! Use code GIFT14 for 10% off your gift. Shop: [store-url]" — sent by email, and SMS if opted in
  • 7 Days Before: "⏰ [Store Name]: Final reminder! Your anniversary is in 7 days. Don't forget - use code GIFT7 for 15% off. Shop: [store-url] Reply STOP to unsubscribe." — sent by email, and SMS if opted in
  • Strategy: Two touches, 14 days and 7 days before, sent through whichever channels the customer opted into
• HELP SUPPORT: Reply HELP to SMS messages for support. Email: [email protected]
• NO SHARING: Phone numbers and emails are NEVER sold, rented, or shared with third parties for marketing purposes.
• ⚠️ STATE RESTRICTIONS: SMS reminders are currently unavailable for residents of Texas, Florida, Oklahoma, Washington, and Tennessee due to state registration and bonding requirements. Customers in these states will still receive email reminders. We apologize for any inconvenience and are working to expand our coverage.
