These SMS Terms & Conditions comply with:

1. Service Description

GiftLoop provides automated SMS text message reminders for gift-giving occasions through participating Shopify merchants. When you provide your mobile phone number and opt-in during checkout, you agree to receive transactional SMS messages reminding you of upcoming occasions you've specified.

2. Consent to Receive Messages

By providing your mobile phone number and clicking "Set Reminder" or similar affirmative action, you expressly consent to receive automated SMS text messages from or on behalf of the merchant where you made your purchase.

Your consent is:

Voluntary: Providing consent is not a condition of any purchase
Specific: You are consenting only to reminder messages for occasions you specify
Revocable: You may opt-out at any time (see Section 5)

3. Message Frequency & Content

Frequency: You will receive 1-2 messages per occasion you sign up for (14 days and 7 days before)
Timing: Messages are typically sent 14 days, 7 days, and 3 days before your specified date
Content: Messages include reminder about upcoming occasion, optional discount code, and link to merchant's store
Hours: Messages are sent between 9 AM and 8 PM in your local time zone

4. Message and Data Rates

Message and data rates may apply. You are responsible for any mobile carrier charges including SMS and data charges. Check with your mobile carrier for details on your plan and potential charges.

5. Opt-Out Instructions

You may opt-out of receiving SMS messages at any time. To stop receiving messages:

Text STOP to any message you receive
You will receive a one-time confirmation message confirming your opt-out.

7. Supported Carriers

Our SMS service is compatible with the following carriers (not exhaustive):

AT&T, Verizon Wireless, T-Mobile, Sprint, Metro PCS
U.S. Cellular, Virgin Mobile, Boost Mobile, Cricket
All major Canadian carriers (Rogers, Bell, Telus)

Note: Carriers are not liable for delayed or undelivered messages.

8. Phone Number Ownership

By providing a phone number, you warrant that you are the authorized user of the mobile device associated with that number. You are responsible for notifying us immediately if your phone number changes or is reassigned.

9. Privacy & Data Security

Your privacy is important to us:

We will NEVER sell, rent, or share your phone number with third parties for marketing purposes
Your information is used solely to provide the reminder service
We maintain industry-standard security measures to protect your data

10. Disclaimer of Warranties

The SMS service is provided on an "AS IS" basis. We do not guarantee:

Delivery of any particular message
Timing of message delivery
Continuous or error-free service

We are not liable for delays, failures, or errors in message delivery which may be caused by carriers, network issues, or other factors outside our control.

11. Limitation of Liability

To the maximum extent permitted by law, GiftLoop and participating merchants shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the SMS service.

12. Dispute Resolution

Any disputes arising from these SMS Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in California.

13. No Warranty for Products

GiftLoop is a reminder service only. We make no warranties or representations about any products or services offered by merchants. All product purchases are subject to the merchant's own terms and conditions.

14. Changes to Terms

We reserve the right to modify these SMS Terms at any time. Material changes will be communicated via the service or through participating merchants. Continued use after changes constitutes acceptance of modified terms.

15. TCPA Compliance Statement

Telephone Consumer Protection Act (TCPA) Compliance

GiftLoop and all participating merchants are committed to complying with the TCPA and all applicable laws regarding SMS communications. We:

Only send messages to users who have provided express written consent
Maintain records of consent including timestamp and IP address
Honor all opt-out requests immediately
Never send messages outside permitted hours
Never send unsolicited promotional messages

17. Participating Merchants

Individual Shopify merchants using GiftLoop are responsible for:

Obtaining proper consent from their customers
Providing accurate business information
Complying with all applicable laws
Honoring discount codes sent via reminders

19. Severability

If any provision of these SMS Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
